Can I file a lawsuit against the cruise line in a court near my home?

Generally, the location where you can sue the cruise line is set forth in the ticket contract. Once you sign up for your cruise, you’ll have an opportunity on the cruise line website to go and print out a copy of your ticket. The ticket is a binding contract between you and the cruise line. Buried in that ticket contract, usually around paragraph 36, you will find what’s known as a choice of law choice of venue provision.

Most of the major cruise lines require that you file suit in Miami, Florida and that has been held to be binding. Some of the west coast cruise lines, such as Princess and Holland America, require suit be filed in California or Washington state. It is important that you check your ticket contract to determine where you must file suit.
