Are punitive damages available in Florida yacht accident cases?

Video Transcription:

Yes, punitive damages are available in a Florida yacht accident case. A Florida yacht accident would be governed under the general maritime law of the United States, which does allow for the recovery of punitive damages in appropriate cases. However, you should remember that punitive damages are damages intended to punish the wrongdoer and are only available in extreme cases, such as where the wrongdoer has acted with intentional disregard for your safety. The best land-based example of this would be, a drunk driver who gets involved in an automobile accident. The conduct would have to rise to that level to entitle you to an award of punitive damages.
